Welcome to www.malaw.us (the "Site"), operated by Malaw Designs ("we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms of Service. If you do not agree, please do not use our Site.

Products and Pricing

All products on our Site are limited-edition art basketballs. Prices are listed in US Dollars (USD) and are subject to change without notice. We reserve the right to modify or discontinue any product at any time. Product images are representative of the artwork; slight variations may occur due to the printing process and the spherical surface of the basketball.

Orders and Payment

By placing an order, you represent that:

  • You are at least 18 years old or have parental/guardian consent
  • The information you provide is accurate and complete
  • You are authorized to use the payment method provided

All payments are processed securely through Snipcart. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in product information, or pricing errors. If your order is canceled after payment, you will receive a full refund.

Shipping

We offer free shipping on orders of $100 or more within the United States. Orders are typically processed within 2-5 business days. Delivery times vary by location and carrier. We are not responsible for delays caused by the shipping carrier, customs, or events beyond our control.

Risk of loss and title for items purchased pass to you upon delivery to the carrier.

Returns and Refunds

We accept returns within 30 days of delivery for unused items in their original condition. To initiate a return:

  1. Email us at sales@malaw.us with your order number and reason for return
  2. We will provide return shipping instructions
  3. Refunds are processed within 5-10 business days after we receive the returned item

Custom-designed basketballs are made to order and are not eligible for returns unless they arrive damaged or defective.

Custom Orders

Custom basketball design requests submitted through our Site are consultations, not binding orders. After reviewing your request, we will contact you within 24 hours to discuss your design, pricing, and timeline. A custom order becomes binding only after you confirm the design and complete payment. Custom orders are non-refundable once production has begun.

Intellectual Property

All content on this Site — including artwork, product designs, photographs, text, logos, and graphics — is the property of Malaw Designs or our artist collaborators (including Mbarou Diodio Camara Ba) and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

Purchasing a Malaw basketball grants you ownership of the physical product. It does not transfer any intellectual property rights in the artwork or designs.

Website Use

You agree to use our Site only for lawful purposes. You may not:

  • Use the Site in any way that violates applicable laws or regulations
  • Attempt to interfere with the Site's operation or security
  • Scrape, crawl, or harvest content from the Site for commercial purposes without permission
  • Submit false or misleading information through our forms

Limitation of Liability

To the fullest extent permitted by law, Malaw Designs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our Site or purchase of our products. Our total liability for any claim related to a purchase shall not exceed the amount you paid for the product.

Disclaimer

Our Site and products are provided "as is" and "as available." We make no warranties, express or implied, regarding the Site's availability, accuracy, or fitness for a particular purpose. Colors and artwork appearance on screen may vary from the physical product due to monitor settings and the nature of printing on a curved surface.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of competent jurisdiction.
